Poor Performance occurs when an employee FAILS to meet the required standards of the role. This could be either behavioural or linked to capability. For example, the person is consistently not meeting deadlines, or are consistently late or their work is sloppy or they are being difficult / unreasonable.

Types of Poor Performance
Capability refers to an employee’s ability to perform their job to the required standard. If an employee is genuinely trying but lacks the necessary skills, knowledge, or competence to fulfil their role effectively, this would be classified as a capability issue and you would follow the Capability Policy & Process.
For example, an employee may:
- Struggle to meet key performance indicators despite best efforts
- Lack the technical skills required for the role
- Be unable to keep up with the workload due to lack of experience or training
Conduct refers to situations where an employee has the skills and ability to perform their role but is choosing not to meet the required standards due to behavioural or attitudinal issues. In this situation you would follow the Disciplinary Process.
Examples of conduct issues include:
- Persistent lateness or absenteeism without a valid reason
- Refusing to follow reasonable management instructions
- Inappropriate workplace behaviour or misconduct
- Poor work ethic despite having the capability to perform well
